Abstract




The problems outlined in this study are about the rights and obligations of the mulih deha widowers in Bali customary law. The aim of this study is to find out what are the rights and obligations of the mulih deha widowers in Balinese customary law. The research method used in this study was the empirical legal research that was focused on the behavior of the legal community and required data sourced from the informants and respondents (field research) as well as library research by collecting written legal materials in the form of awig - awig and materials obtained from literatures about law science. The result of this study shows that the widowers, after returning to their home, lose his right to become the heir, unless there is another decision or agreement amongst the family. A man's status as a widower in a nyentana marriage would be the pradana. Therefore, the custody of the children would belong to the wife (as the purusa ). A mulih deha widower is obligated to continue his service in his family life and society. Obligations carried as a liability is not as a pengayah arep but as pengayah pengele . Pengayah pengele carry lighter duties or obligations compared to pengayah arep. Obligations to the children depend on agreement made between parties who have divorced.
