Companion workers are Indonesian workers appointed by the company as foreign laborers in order to transfer technology and transfer expertise. The legal basis for counterpart work is Article 45 of Law Number 13 Year 2003 concerning Manpower. This article emphasizes the obligation of employers to appoint Indonesian workers as a companion to foreign workers in the context of technology transfer and transfer of expertise. The formulation of the problem raised in this study is how the implementation of Article 45 of the accompanying workers, because foreign workers have a living limit in Indonesia. And what are the factors that hamper counterpart workers towards the application of the Manpower Act. The method used in this study is an empirical research method that is an approach by looking at something of the legal reality in society to find out the extent to which the law in the law is applied in society. Based on the results of research by the author, the application of Article 45 of Law Number 13 Year 2003 concerning Manpower, the transfer of technology and transfer of expertise from foreign workers to counterpart workers by carrying out work orders from foreign workers in accordance with work procedures has been determined by the company and in accordance with company needs, whether it is in the form of expertise, knowledge and technology that is owned by foreign workers. Furthermore, the factors that hampered co-workers in the application of Law No. 13 of 2003 concerning Manpower are communication, including foreign workers who cannot speak Indonesian, then culture, due to differences in position and there is a sense of reluctance from co-workers towards workers foreign work which is considered to be a higher position and the last is social jealousy, that is, the salary of labor is ten times that of counterpart workers, but the counterpart workers realize that foreign workers are really needed in the company and companion workers have motivation and work loyalty towards the company only to get wages to meet family needs.
